    Article 1. Definitions

    In these general terms and conditions, the following terms are used in the meaning hereafter, unless expressly stated otherwise:

    1. The Great Escape: the private company with limited liability The Great Escape Center B.V., also trading under the name www.verbaasjecollegas.com.
    2. Client: the natural or legal person who enters into an agreement with The Great Escape.
    3. Participant: natural person who participates in an Activity of The Great Escape.
    4. Activity: the service(s) or arrangement offered by The Great Escape.
    5. Program: the collection of Activities reserved by the Client.
    6. Parties: The Client and The Great Escape together.
    7. In writing: “in writing” also includes communication by e-mail, fax or digitally, provided the identity of the sender and the integrity of the content are sufficiently established.

    Article 2. Applicability

    1. These terms and conditions apply to all offers, quotations and agreements relating to the Activities and/or (group) arrangements organized or offered by The Great Escape.
    2. If The Great Escape has allowed deviations from these general terms and conditions, for a short or longer period, explicitly or implicitly, this does not affect its right to demand immediate and strict compliance with these terms and conditions.
    3. The Great Escape reserves the right to amend these terms and conditions at any time.
    4. If one or more of the provisions of these general terms and conditions should be in conflict with a mandatory legal provision, the relevant provision shall lapse and shall be replaced by a comparable provision.
    5. These terms and conditions also apply to all agreements with The Great Escape, for the execution of which third parties must be involved.

    Article 3. Formation of the agreement

    1. An agreement is formed when the Client places a reservation via the website or orally (also by telephone) with The Great Escape and receives a confirmation thereof.
    2. The person who enters into the agreement on behalf of, or for the benefit of, the group (the Client), is jointly and severally liable for all obligations arising from this agreement, as well as for any damage caused by the Participants.

    Article 4. Execution of the agreement

    1. The Great Escape will execute the agreement to the best of its knowledge and ability and in accordance with the requirements of good craftsmanship.
    2. If and insofar as good execution of the agreement requires it, The Great Escape has the right to have certain work carried out by third parties.
    3. The client ensures that all necessary data is provided to The Great Escape in a timely manner.
    4. The Great Escape is not liable for damage caused by The Great Escape relying on incorrect and/or incomplete data provided by the Client.
    5. The client indemnifies The Great Escape against any claims from third parties.

    Article 5. Payment

    1. Unless expressly agreed otherwise, payment will be made prior to the Activity by means of online payment or debit card payment at the location. If it has been agreed that payment will be made by invoice, the Client must have paid the full amount within 14 days of receiving the invoice.
    2. After the agreed payment term has expired, The Great Escape will send the Client a reminder and offer a reasonable period to still meet their payment obligation.
    3. From the moment of default, the Client owes the statutory interest on the due amount. The Client owes compensation of at least 5% of the outstanding amount, with a minimum of € 40.00.

    Article 6. Reservation sum

    1. The published reservation sum includes the costs for all necessary items for the relevant Activity, unless stated otherwise. Prices stated on the website, in quotations or otherwise are per person and include VAT, unless stated otherwise.
    2. The Great Escape reserves the right to change the price before the booking is made, if there is reasonable cause to do so.

    Article 7. Start and end time

    The start and end time of an Activity will be recorded in the reservation confirmation. If a Program or Activity needs to be adjusted because a participant is not present on time, The Great Escape will charge the Client for any additional costs incurred.

    Article 8. Change and cancellation of the reservation

    The reservation can be changed by the Client in consultation with The Great Escape. If changing the number of participants results in fewer participants, the cancellation conditions apply.

    Cancellations regarding COVID-19

    Cancellations during a government-imposed lockdown can be rescheduled free of charge to another suitable date.

    Online outing

    • Cancellation/rescheduling more than 14 days before commencement: free of charge.
    • Cancellation/rescheduling less than 14 days but more than 72 hours: 50% of the total invoice.
    • Cancellation less than 72 hours before commencement: 100% of the total invoice.

    One escape room or outdoor experience

    • Cancellation/rescheduling more than 7 days in advance: free of charge (voucher or refund).
    • Cancellation/rescheduling more than 48 hours but less than 7 days: voucher.
    • Cancellation/rescheduling less than 48 hours: 100% of the total invoice.

    Two or more escape rooms or outdoor experiences

    • Cancellation/rescheduling more than 14 days before commencement: free of charge (voucher or refund).
    • Cancellation/rescheduling less than 14 days but more than 7 days: voucher.
    • Cancellation/rescheduling less than 7 days but more than 96 hours: 50% of the total invoice.
    • Cancellation/rescheduling less than 96 hours: 100% of the total invoice.

    Packages

    • Cancellation/rescheduling more than 3 weeks before commencement: free of charge.
    • Cancellation/rescheduling less than 3 weeks but more than 1 week: 50% of the total invoice.
    • Cancellation less than 1 week: 100% of the total invoice.

    Cancellations must be made in writing by email to info@thegreatescape.info to happen. Telephone and verbal cancellations are not legally valid.

    Article 9. Non-continuation of activities or changes

    1. The Great Escape reserves the right to make changes to the Program if there are valid reasons for doing so.
    2. The Great Escape will inform the Client about this as soon as reasonably possible.
    3. If The Great Escape decides not to proceed with (parts of) a Program, The Great Escape commits to issuing a voucher equal to the value of the relevant Program (valid for 12 months).
    4. It is not allowed to participate in the Activities under the influence of drugs and/or alcohol.

    Article 10. Complaints

    Complaints must be submitted directly to the staff during the Activity or on the first working day after the Activity. Complaints submitted after one week will not be processed.

    Article 11. Liability

    1. If The Great Escape is liable for damages, that liability is limited to compensation for direct damages and to a maximum of the total amount charged.
    2. The Great Escape accepts no liability for damage resulting from death, injury, accidents, wounds, loss or theft.
    3. The Great Escape accepts no liability for costs incurred by the Client if an Activity cannot proceed.
    4. Damage or loss caused by the participant will be recovered from the Client.

    Article 12. Suspension and dissolution

    1. The Great Escape is authorized to suspend the fulfillment of obligations or to dissolve the agreement if the Client fails to comply with the obligations.
    2. Furthermore, The Great Escape is authorized to dissolve the agreement if circumstances arise that make performance impossible.
    3. If the agreement is dissolved, the claims of The Great Escape on the Client are immediately due and payable.

    Article 13. Force majeure

    1. The Great Escape is not obliged to fulfill any obligation if it is hindered from doing so due to force majeure.
    2. Force majeure is understood to mean all external causes, foreseen or unforeseen, over which The Great Escape has no control. Strikes are included.
    3. The Great Escape also has the right to invoke force majeure if the circumstance occurs after it should have fulfilled its obligation.
    4. The Great Escape can suspend its obligations during the period of force majeure. If this period lasts longer than two months, The Great Escape is entitled to dissolve the agreement.

    Article 14. Applicable law and choice of forum

    1. This agreement is exclusively governed by Dutch law.
    2. The court in the district where the Client resides has exclusive jurisdiction to hear disputes.
    3. Parties will only appeal to the court after they have made every effort to settle a dispute by mutual agreement.

    Article 15. Amendment, interpretation and place of filing of the terms and conditions

    1. In case of interpretation of the content and scope of these general terms and conditions, the Dutch text shall always prevail.
    2. The most recently filed version or the version that applied at the time the agreement was concluded shall always apply.
    3. The general terms and conditions will be sent free of charge upon request.
